Rep. Tracey Bernett charged after Boulder DA said she falsified address

The Boulder District Attorney’s Office has filed charges against House District 12 Rep. Tracey Bernett, alleging that Bernett lied about her primary residence to run for reelection this year.

Bernett is charged with attempt to influence a public servant, forgery, providing false information about a residence, perjury and procuring false registration.

Bernett turned herself in to the Boulder County Jail and was released on a $10,000 personal recognizance bond and is set for a court appearance on Nov. 17.

“The District Attorney’s Office has concluded a thorough investigation,” Boulder County District Attorney Michael Dougherty said in a statement. “I appreciate the efforts of the investigators assigned to this case, including using proper investigative tools such as the judicially authorized search warrants. Based on the facts and the law, we will now move forward with a criminal prosecution. As in every case, our goal is to seek the right outcome — without fear or favor.”

Louisville resident Theresa Watson filed a complaint with the DA’s Office in September claiming Bernett falsified her residency.

Bernett, who is currently serving her first term in office, listed the same Crestview Lane address on her candidate affidavits in 2018, 2019 and 2020, according to campaign filings with the Colorado Secretary of State’s Office.
